1. Agreement to these terms

These Terms of Service (“Terms”) govern your access to and use of the website operated by AFFILIATE GROWTH NETWORK LLC (“Affiliate Growth Network”, “we”, “us”), and any enquiry you submit through it. By using this website you agree to these Terms. If you do not agree, do not use the site.

Where we enter into a separate written agreement with you — an insertion order, partner agreement, statement of work, or master services agreement — that agreement governs the services described in it, and these Terms apply only to your use of this website to the extent they do not conflict with it.

2. Who we are and what we do

We are an independent performance marketing and offer-partnership company. We work with advertisers, publishers, and affiliates to connect approved offers with qualified traffic, support campaign setup and tracking, review lead routing and quality, produce creative and landing experiences, and report on results.

We are not an advertising platform, a payment processor, or a party to the agreements our partners hold with third parties. We are not affiliated with or endorsed by any advertising platform, network, or publisher, and nothing on this site should be read as implying such a relationship.

3. No guarantee of results

This is the most important section of these Terms, and we would rather you read it before you read anything else.

We do not guarantee traffic volume, clicks, impressions, leads, lead acceptance, earnings per click, conversion rates, revenue, return on investment, search rankings, placements, offer availability, or approval by any advertiser, network, publisher, or advertising platform. Performance depends on partner terms, platform policies, creative, competition, geography, seasonality, budget, and offer quality, most of which are outside our control.

Any figures, charts, examples, or illustrations on this website are structural illustrations of how we present information. They are not client results, benchmarks, forecasts, or representations of what you should expect. Results vary by offer, geo, traffic source, creative, competition, and budget.

AI-assisted recommendations are decision support. Operators review changes before they go live. We make no representation that AI-assisted analysis will improve performance.

4. Eligibility and acceptable use

You may use this website only if you are at least 18 years old and able to form a binding contract. You agree not to:

• Use the site or any service in violation of applicable law, platform policy, or the terms of any offer.
• Submit false, misleading, or fraudulent information, including through our contact form.
• Generate or submit incentivised, misrepresented, co-registered without disclosure, bot-generated, or otherwise invalid traffic or leads.
• Use trademarks, brand names, endorsements, testimonials, or likenesses without the rights to do so.
• Make health, income, or financial claims that the advertiser cannot substantiate.
• Attempt to gain unauthorised access to the site, probe or scan its infrastructure, or interfere with its operation.
• Scrape, republish, or resell content from this site without written permission.

We may suspend or terminate access, and where applicable withhold amounts related to invalid activity, if these rules are breached.

5. Partner relationships and third parties

Introductions we make are subject to the terms of the offer owner, the network, and the platforms involved. Offers and campaigns are subject to partner, publisher, and platform review, and access may be withdrawn or changed at any time by those parties.

We are not responsible for the acts or omissions of advertisers, networks, publishers, affiliates, or advertising platforms, including their approval decisions, payment behaviour, policy enforcement, or the accuracy of the reporting they provide. Where we pass through a third party's data or terms, we do so as received.

6. Enquiries and communications

When you submit an enquiry you confirm that the information is accurate and that you are authorised to submit it on behalf of the company named. We use it as described in our Privacy Policy. Submitting an enquiry does not create a partnership, a contract, or an obligation on either side, and we may decline any enquiry for any lawful reason.

7. Intellectual property

The site, its design, text, graphics, illustrations, code, and all inline visualisations are owned by us or licensed to us and are protected by intellectual property laws. You may view and print pages for your own business evaluation. You may not copy, adapt, republish, or use them commercially without our written permission.

Creative we produce for a partner is governed by the agreement covering that work. Third-party marks appearing in any campaign remain the property of their owners.

8. Disclaimers

The website and its content are provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted availability, to the maximum extent permitted by law.

Nothing on this site is legal, regulatory, tax, financial, or compliance advice. You are responsible for obtaining your own advice on the rules that apply to your offers, your claims, and the markets you operate in. See our Disclaimer for further detail.

9. Limitation of liability

To the maximum extent permitted by law, Affiliate Growth Network and its officers, employees, and contractors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, lost business opportunity, or loss of goodwill, arising out of or related to your use of this website or any services, whether based in contract, tort, statute, or otherwise, even if advised of the possibility of such damages.

Our total aggregate liability arising out of or related to your use of this website is limited to one hundred US dollars (US$100). Where we have a separate written agreement with you, the liability provisions of that agreement govern the services it covers.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages. In those jurisdictions our liability is limited to the greatest extent permitted by law.

10. Indemnity

You agree to indemnify and hold harmless Affiliate Growth Network and its officers, employees, and contractors from any claim, demand, loss, liability, or expense (including reasonable legal fees) arising from your breach of these Terms, your violation of applicable law or platform policy, your traffic or creative, or any claim you made that you could not substantiate.

11. Governing law and disputes

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-laws principles. The parties submit to the exclusive jurisdiction of the state and federal courts located in Miami-Dade County, Florida, and waive any objection to venue there.

Before filing a claim, each party agrees to attempt to resolve the dispute in good faith by contacting the other in writing at the addresses in these Terms and allowing thirty (30) days to respond.

12. Changes, severability, and contact

We may update these Terms from time to time. The date at the top of this page reflects the latest version, effective September 2026. Continued use of the site after a change means you accept the updated Terms.

If any provision is found unenforceable, the remainder stays in force. Our failure to enforce a provision is not a waiver of it. These Terms, together with any separate written agreement, form the entire agreement between us regarding the website.
